Throughout this Privacy Policy, we refer to our website, our hosted services (including the Business Brand Commander and Personal Brand Commander products), and other related services collectively as the "Service."

In addition, upon using our Personal Brand Commander or Business Brand Commander services, we collect or generate the following categories of information:

• Brand voice and identity data. Content of onboarding interviews, brand voice guides, positioning statements, biographical content, and personal stories provided by you for use in content creation.

• Audience and market data. Ideal Customer Profile information, target audience descriptions, competitor information, and industry positioning data.

• Third-party contact information. When relevant to your service tier, contact information for podcast hosts, publication editors, event organizers, and other third parties that you have authorized us to engage with on your behalf as part of outreach activities.

• Content drafts and final assets. Articles, blog posts, social media content, email pitches, speaker materials, and other content created on your behalf and delivered to you.

• Engagement metrics. Open rates, response rates, and other tracking metrics from outreach activities conducted on your behalf (Pro and VIP tiers only).

• Website and platform usage data. Browser type, IP address, pages viewed, time spent on pages, and other standard web analytics.

We also use cookies so that our Website can remember you and provide a more efficient experience. Cookies identify returning users, support faster login, and help us compile statistical information about Website use such as time spent on the site and pages visited most often. Statistical information collected through cookies does not include PII.

How We Use Personally Identifiable Information

We use your Personally Identifiable Information to:

• Create and manage your account

• Communicate with you about products and services you have purchased

• Offer additional products and services

• Bill you for services

• Deliver the Service you have purchased, including all content production, research, outreach, and platform hosting activities

• Enforce our Terms of Service

• Prevent imminent harm to persons or property

When you use the Service, including making a payment, contacting customer service, or requesting technical support, we will apply the information we have collected. This allows us to verify your identity, communicate with you, enforce our agreements with you, and ensure compliance with applicable U.S. state and federal laws and our own policies. We may also use this information to improve and enhance our offerings.

AI Brand Commander may use certain information about you without identifying you as an individual to third parties. We do this for purposes such as analyzing how the Service is used, diagnosing service or technical problems, maintaining security, and personalizing content.

Third-Party Service Providers and Data Processors

To deliver the Personal Brand Commander and Business Brand Commander services, we use the following third-party platforms. Each is governed by its own privacy policy. Your data may be transmitted to, stored on, or processed by these providers as part of normal service delivery.

Google Workspace (Google Drive) Shared folder used as the delivery destination for all content drafts, research reports, brand assets, and (for Lite tier) email pitch drafts All deliverable content and research outputs associated with your account.

Stripe / GHL Payments Payment processing for setup fees and recurring subscription billing Credit card or payment information, billing address, transaction history.

Email service providers Transactional email (onboarding, billing notices, reports) Name and email address. For Pro and VIP tier customers: outreach emails sent on your behalf to podcast hosts, editors, and event organizers are transmitted through our email tracking pipeline. Recipients of these emails see your name and signature, not AI Brand Commander's. Engagement metrics flow back to your monthly performance report.

We require all third-party processors to maintain reasonable data security standards. We do not authorize any third-party processor to sell or repurpose your data outside the scope of providing the contracted Service.

Protecting Personal Information

Information that can be used to identify a person is "Personally Identifiable Information." This does not include information that has been aggregated or made anonymous. All information is securely stored on servers in the United States or, in the case of third-party processors, in their respective infrastructure regions. We employ industry-standard security practices to protect Personally Identifiable Information.

Third-party contact information you provide to us (such as podcast host contact lists, editor contact information for publication outreach) is considered confidential and is used only for the purpose for which it was provided, which is to facilitate authorized outreach activities on your behalf.

Although AI Brand Commander uses commercially reasonable data security practices, we cannot guarantee the security of PII or other information provided to us. By using our Service, you acknowledge and agree that we make no such guarantee, and that you use our Service at your own risk.

Sharing Personal Information

AI Brand Commander will not rent or sell your Personal Information to others.

We may store personal information in locations outside the direct control of AI Brand Commander (for instance, on servers or databases co-located with hosting providers and third-party service providers identified in this Privacy Policy). AI Brand Commander will share your Personal Information with a limited number of partners for the explicit purpose of providing the Service to you. Such third parties' use of your Personal Information will be bound by terms at least as restrictive as this Privacy Policy.

As we develop our business, we may buy or sell assets or business offerings. Customer, transaction, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer such information in the course of corporate divestitures, bankruptcy, mergers, or dissolution.

Except as otherwise described in this Privacy Policy, AI Brand Commander will not disclose Personal Information to any third party unless required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) enforce our Terms of Service, take precautions against liability, investigate and defend ourselves against any third-party claims or allegations, assist government enforcement agencies, or protect the security or integrity of our Service; and (c) exercise or protect the rights, property, or personal safety of AI Brand Commander, our customers, or others.

Your Content and Intellectual Property

You retain full ownership of all content, brand assets, research outputs, and other intellectual property generated under your engagement with AI Brand Commander. This includes content delivered to your Google Drive folder and content published on your behalf to your personal brand website, blog, and social media accounts.

AI Brand Commander retains the right to use anonymized or aggregated insights from service operations for product improvement and to highlight service results in marketing materials. We do not retain or repurpose client-specific intellectual property without your written consent. Specific intellectual property terms are set out in our Terms of Service.

Compromise of Personal Information

In the event that personal information is compromised as a result of a breach of security, AI Brand Commander will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, by email or as otherwise required by applicable law.

AI Brand Commander shall not be liable for the transfer of any personal identification information resulting from loss or distribution of data, the deletion or corruption of storage media, power failures, natural phenomena, riots, acts of vandalism, sabotage, terrorism, or any other event beyond AI Brand Commander's control.

Your Choices About Your Information

You may decline to submit personally identifiable information through the Service. In that case, AI Brand Commander may not be able to provide certain services to you. You may update or correct your account information at any time by logging in to your account or by contacting us using the contact information below.

Data export and account closure. Upon cancellation of your service, you may request export of all account data and content within 30 days of the cancellation effective date. Data export includes:

• All content drafts and final assets stored in your shared Google Drive folder

• Your brand voice guide and ICP research outputs

• Your personal brand website, blog content, and contact lists from your BizPilot subaccount (if you do not elect to retain the subaccount under our retention option)

• Any other deliverables produced under your engagement

Cancellation, retention of your BizPilot subaccount, and domain transfer options are governed by our Terms of Service.

Information Relating to Minors

AI Brand Commander does not knowingly collect or solicit personal information from anyone under the age of 18 or knowingly allow such persons to register for our Service. If you are under 18, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 18 is allowed to provide any personal information to or on AI Brand Commander. In the event that we learn we have collected personal information from a minor under age 18 without verification of parental consent, we will delete that information as quickly as possible. If you believe we might have any information from or about a child under 18, please contact us as described below.

AI Brand Commander is not responsible for the practices employed by websites linked to or from our Website, nor the information or content contained therein. When you use a link to go from our Website to another website, our Privacy Policy is no longer in effect.
